New Swimming Pool Regulations

As you will undoubtedly know, the 29th October 2013 deadline for complying with the Swimming Pools (Amendment) Act 2012, calling for the registration of all backyard swimming pools, is fast approaching.

The NSW Swimming Pool Register has now gone live, allowing householders to register their backyard swimming pools ahead of the October deadline.

The Swimming Pools (Amendment) Act requires all homeowners to register their pools online by 29 October 2013, or face paying a fine. But the register is now up and running and NSW pool owners can register their pools now.

Pool owners will also be required to provide a valid compliance certificate before being able to sell or lease a property with a pool as of 29 April 2014.

The legislation also outlines requirements for councils, which include:

  • organising a pool barrier inspection program by 29 October 2013, and inspecting any pool that is complained about to the counc il;
  • compiling an annual report on the number of pool inspections undertaken and the level of compliance with the requirements;
  • conducting pool inspections prior to the sale or lease of a property at the request of a pool owner; and
  • issuing compliance certificates, valid for three years, after an inspection which finds a pool barrier compliant with the requirements of the legislation.

Councils may charge a fee up to a maximum of $150 for the inspections.
