New Swimming Pool Regulations

Chris Hasson explains the new Swimming pool Act for Real Estate Sales

As you will undoubtedly know, the 29th October 2013 deadline for complying with the Swimming Pools (Amendment) Act 2012, calling for the registration of all backyard swimming pools, is fast approaching.

The NSW Swimming Pool Register has now gone live, allowing householders to register their backyard swimming pools ahead of the October deadline.

The Swimming Pools (Amendment) Act requires all homeowners to register their pools online by 29 October 2013, or face paying a fine. But the register is now up and running and NSW pool owners can register their pools now.

Pool owners will also be required to provide a valid compliance certificate before being able to sell or lease a property with a pool as of 29 April 2014.

The legislation also outlines requirements for councils, which include:

  • organising a pool barrier inspection program by 29 October 2013, and inspecting any pool that is complained about to the counc il;
  • compiling an annual report on the number of pool inspections undertaken and the level of compliance with the requirements;
  • conducting pool inspections prior to the sale or lease of a property at the request of a pool owner; and
  • issuing compliance certificates, valid for three years, after an inspection which finds a pool barrier compliant with the requirements of the legislation.

Councils may charge a fee up to a maximum of $150 for the inspections.

I hope the video above answered some Real Estate questions. I’m sure it created some more questions. I purposely left out what I think is going to happen in the Real Estate market. But for those who are interested I’m happy to give my commentary at a FREE consultation. But onto the report. It’s been a very buoyant Real Estate market with in many cases, supply levels down as much as 46% and demand up as much as 22%. And with Real Estate being all about supply and demand it is a great time for selling. Most Real Estate sales people and Real Estate businesses are recording record figures. This is on the back of record low Interest rates, a rising popularity of self managed Super Funds as well as buying property in Super because of the relatively unstable share market climate. Lets look at the sales for the year so far suburb by suburb.

There has been in total 30 sales in Nelson Bay for the first half of 2013. The medium sale price has dropped from $386,000 to $300,500 for units and risen from $380,000 to $431,000 for homes.

This photo is at the western end of Shoal Bay beach looking out through the Port Stephens Heads. That is Tomaree Mountain(right) and Yaccaba on the left. Have a close look at the snorkeler in the picture.

There has been a total of 21 sales in Shoal Bay this year so far with the medium sale price in houses rising from $379,000 to around $500,000. Now this figure is a little ambiguous as we did sell a rare Shoal Bay “waterfront” (actually across the road from the waterfront) for around the $2,000,000 mark. With unit medium sale prices in the Shoal Bay Real Estate Market going from $340,000 up $362,000.

Fingal Bay Property Update

Fingal Bay has had 17 sales settled in the first half of the 2013 Port Stephens Real Estate calendar. The medium sale price of houses went from $815,000 to $558,000. And the medium unit price went from $1,600,000 to $300,000. These figures may seam alarming for fingal Bay residents but what the trend is showing is that a few highly expensive homes and Units sold over the holiday time and the more modest homes and townhouses as well as duplexes sold through the later part of the year. A very typical fluctuating medium sale price is normal for the Port Stephens Real Estate climate.

There has been 23 sales in Corlette settled so far in Corlette. Corlette has been the most popular Suburb for general buyer inquiry closely followed by Nelson Bay. The medium sale price for houses has gone from $470,000 to $471,000. The reason for this drop has been a lot of houses and duplexes in the $350,000 to $450,000 range as well as quite a few blocks of land.

The Horizons Golf Course has been a championship course in it's time. Unfortunately due to financial constraints recently the course has been run by volunteers. Amazingly the course is still in good shape and worth a game of golf. Reserve Banks Effect On Port Stephens Real EstateWhat Does No Interest Rate Drop In September Really Mean?

As you are well aware by now the Reserve bank decided to keep the cash rate on hold for the month of September:

“The Reserve Bank today kept its cash rate at 4.25 per cent, defying expectations of a third rate cut in a row – just three of 27 economists polled by Bloomberg predicted the result.” SMH

This decision is right at the start of spring time selling and with the announcement coming on the back of a suggestion that the rates will probably remain on hold till the end of the year, the big question is:

“How will this decision effect spring time Real Estate markets?”

I believe there are 2 answers to this question. Each with there own question. Confused? Your with the rest of the best economics in the country. But lets start with what happened immediately.

The Sydney morning Herald reported that the Aussie Dollar rocketed on the news, jumping about one US cent to $US1.081 – a six-month high – within minutes of the announcement before easing back to $US1.078.

So if this continues it can’t be good for retail, and if retail is not good, small business is not good, and if small business is not good, the Real estate is affected. The big question is, will the dollar keep rising leading to Christmas?

So whats the good news?

Here’s why I believe the announcement was a good decision for the Port Stephens Property Market:

  • Real Estate markets are about confidence  and at the start of Spring Selling, it gives confidence to the market that things are going well in Australia
  • Supply is down by about 36% and inquiry up 6.5% so the announcment has come at a good time in the market for people deciding if they put their properties on the market(Real estate is about supply and demand)
  • And finally it leaves plenty of room leading up to Christmas for a drop if needed.

And the question this leads to is “Will the supply rise dramatically in Spring or will the demand increase as supply increases?”
